Who is responsible for processing your personal data?

FAICOM PACKAGING INDUSTRIAL S.L. is the DATA CONTROLLER responsible for processing the USER’s personal data and hereby informs the USER that such data will be processed in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Spanish Organic Law 3/2018 of 5 December on Personal Data Protection and Guarantee of Digital Rights (LOPDGDD).

Why do we process your personal data?

To maintain a business relationship with the user. The intended processing activities include:

• Sending advertising and marketing communications by email, fax, SMS, MMS, social media or any other electronic or physical means, whether existing or developed in the future, that enable commercial communications. These communications will be sent by the DATA CONTROLLER and will relate to its products and services or those of its partners or suppliers with whom it has entered into promotional agreements. In such cases, third parties will never have access to personal data.
• Conducting market research and statistical analyses.
• Processing orders and requests, responding to enquiries or handling any other type of request submitted by the USER through any of the contact methods made available on the DATA CONTROLLER’s website.
• Sending our online newsletter containing news, offers and promotions relating to our business activities.

What is the legal basis for processing your personal data?

Processing is lawful under Article 6 of the GDPR on the following grounds:

• With the USER’s consent: sending marketing communications and newsletters.
• On the basis of the DATA CONTROLLER’s legitimate interests: conducting market research, statistical analyses, etc., and processing orders, requests and other enquiries submitted by the USER.

How long will we retain your personal data?

Personal data will be retained only for as long as necessary to fulfil the purposes for which it was collected, or for as long as required by applicable legal obligations. Once the data is no longer required, it will be deleted using appropriate security measures to ensure its anonymisation or complete destruction.

With whom do we share your personal data?

No disclosure of personal data to third parties is envisaged, except where necessary for the development and fulfilment of the purposes of processing, to our communications-related service providers. The DATA CONTROLLER has entered into the confidentiality and data processing agreements required by applicable data protection legislation with these providers.

What are your rights?

The USER has the following rights:

• The right to withdraw consent at any time.
• The rights of access, rectification, data portability and erasure, as well as the right to restrict or object to the processing of personal data.
• The right to lodge a complaint with the supervisory authority (www.aepd.es) if you believe that the processing of your personal data does not comply with current legislation.

2. MANDATORY OR OPTIONAL NATURE OF INFORMATION PROVIDED BY USERS

By ticking the relevant boxes and entering data into fields marked with an asterisk (*) in the contact form or included in download forms, USERS expressly, freely and unequivocally acknowledge that such data is necessary for the service provider to process their requests. Providing information in the remaining fields is voluntary. The USER guarantees that the personal data provided to the DATA CONTROLLER is accurate and undertakes to notify the DATA CONTROLLER of any changes to this information.

The DATA CONTROLLER informs USERS that all data requested through the website is mandatory, as it is necessary to provide the USER with an optimal service. If all the requested information is not provided, the DATA CONTROLLER cannot guarantee that the information and services supplied will fully meet the USER’s needs.

3. SECURITY MEASURES

In accordance with applicable personal data protection legislation, the DATA CONTROLLER complies with all provisions of the GDPR and the LOPDGDD concerning the processing of personal data under its responsibility, particularly the principles established in Article 5 of the GDPR. Accordingly, personal data is processed lawfully, fairly and transparently in relation to the data subject and is adequate, relevant and limited to what is necessary for the purposes for which it is processed.

The DATA CONTROLLER guarantees that it has implemented appropriate technical and organisational policies to apply the security measures required by the GDPR and the LOPDGDD, with the aim of protecting the rights and freedoms of USERS. It has also provided USERS with the information necessary to exercise these rights.
